House Floor Amendment No. 1
Deletes provision that knowledge shall be determined by the attempted use of a prescription altered or not issued by a licensed prescriber. Provides that the penalty for prescription theft is a Class 3 felony if the person has previously been convicted of theft or retail theft. Provides that a second or subsequent conviction of prescription theft is a Class 2 (rather than a Class 3) felony.
